Wills and estates: 1785-1859

Use the information below to find wills and estate files at the Archives of Ontario from 1785 to 1859. Estates during this period were handled by the Court of Probate.


Find files from before 1793

We hold wills from as early as 1785 for the following three districts/counties:

Hesse District (Lake Erie and Windsor area)

To find a will:

  1. Request to view in person a copy of the Hesse District Prerogative Court register (RG 22-6)
  2. If you find the name of the person you are seeking in the register, ask the reference desk to retrieve the file or order a reproduction.

Lunenburg District (Upper Canada-Lower Canada border area)

To find a will:

  1. Request to view in person the Lunenburg District Prerogative Court minute book and register excerpts (RG 22-7)
  2. If you find the name of the person you are seeking in the register, ask the reference desk to retrieve the file or order a reproduction.

Essex County and Leeds and Grenville County

To find a will:

  1. Search for the name of the person you are looking for in Collection Search.
  2. Take note of the name, location, file number, microfilm reel number, and whether the file is from the Probate or Surrogate Court. If there is no file number, the files will be arranged alphabetically.
  3. Retrieve the microfilm from the self-service cabinet in the Reading Room.

Find files from 1793-1858

To find a will and estate file from 1793 up to 1858:

  1. Search for the name of the person you are looking for in Collection Search.
  2. Take note of the reference code, name, location, file number, microfilm reel number, and whether the file is from the Probate or Surrogate Court. If there is no file number, the files will be arranged alphabetically.
  3. Search the table below to find links to the Probate or County Court records that match your search.
  4. Browse the microfilm reels on FamilySearch or in person by range of file numbers to find the one that includes the will you need.
